Registration for Bank Alfalah Internet Banking

These terms and conditions set out below govern use of the Internet Banking by the "Customer" (In case of the Corporate Entity Customer same shall be applicable to the authorized person / user of the Corporate Entity), online access to our services and shall operate as legally binding agreement between you and us ("Bank Alfalah Limited") for governing our relationship.
  1. Scope: These terms and conditions govern our relationship regarding the Internet Banking of Bank Alfalah Limited reserves the right to change the terms and conditions at any time. Any such change may be notified to you, in writing or by being published on the Web site. These terms and conditions shall be in addition to and not in derogation of the terms and conditions that are applicable to any Account, Product(s) and Services provided by/ maintained at /with Bank Alfalah Limited.
  2. Security of Passwords: You agree that you are entirely responsible for maintaining the confidentiality of your Password. You agree to immediately notify us if your Password is lost, stolen, disclosed to an unauthorized third party or otherwise may have been compromised. You agree to immediately notify us of any other breach of security in relation to the Internet Banking that comes to be known to you. You agree that you are entirely responsible for any and all activities that occur using your Password whether or not you are the individual who undertakes such activities. You should change your Password regularly and make sure that you do not choose a Password you have used before.
  3. Contents & Services: We reserve the right to change or discontinue the contents and services made available on the Internet Banking at any time.
  4. Shared Facilities:You are advised not to access the services provided to you under these Terms & Conditions/ Agreement by using any device available at a public place or any device which might be shared with others. Such use may expose you to risks or breach of the security, integrity and confidentiality of your use of the Internet Banking. You must not leave your System unattended while you are logged online to the Internet Banking. Make sure that you have logged off after each session.
  5. System Integrity: You may not use any device software or routine to interfere or attempt to interfere with the proper working of the Internet Banking or a transaction relating to it.
  6. Virus Protection: You must take all reasonably practicable measures to ensure that any computer or other device from which you access the Internet Banking is free of any computer virus or similar device or software including but not restricted to, devices commonly known as software bombs, Trojan horses and worms (together "Viruses") and is adequately maintained in every way. The Internet Banking can be accessed through the internet on personal computers or via public internet cafes over which we have no control. You must therefore ensure that any computer or other device you use to access the Internet Banking is adequately protected against acquiring Viruses.
  7. Security: (a) You acknowledge that internet based communications might not be totally secure and despite best efforts there remains the risk of unauthorized access and hacking. Bank Alfalah Limited, therefore, does not assume any liability for unauthorized invasion of the Internet Banking by third party or corruption of the data. (b) If you become aware of any transaction on any of your accounts that has not been performed by you, you must notify us immediately in writing or by calling our concerned Bank Alfalah Limited Branch within 30 days for such suspicious / disputed transaction, thereafter Bank shall not be liable for any such suspicious / disputed transaction.
  8. Site Material: Nothing on this Internet Banking should be interpreted to be any invitation or offer relating to an investment or to engage in any other transaction. Bank Alfalah Limited assumes no risk or responsibility as regards use of the contents of the Internet Banking including the information or communication from any cyber linked sites.
  9. Copyright and Trademark: All contents of the Internet Banking including contents within the Internet Banking, such as text, graphics, icons, images and software ("Materials") is the exclusive property of Bank Alfalah Limited. Bank Alfalah Limited authorizes to you to view and download the Materials of this Internet Banking only for your own use. The Materials may not be modified in any way or reproduced or displayed or used for any public or commercial purpose. The trademarks, site marks and logos used and displayed on the Internet Banking are the property of Bank Alfalah Limited. Nothing on the Internet Banking should be construed as granting any license or right to use mark, site marks or logos without written permission of Bank Alfalah Limited.
  10. Third Party Cyber Links: Any cyber links available on the Internet Banking do not constitute endorsement by the Bank and affiliates of the opinions or views of such third party. Bank Alfalah Limited does not verify, endorse, or take responsibility for the accuracy, completeness or quality of the contents contained in such Sites. Furthermore, Bank Alfalah Limited is not responsible for the quality or delivery of the products or services accessed, obtained by or advertised at such Sites. Bank Alfalah Limited shall under no circumstances be liable for any direct, indirect, incidental or special loss or damage whether arising from negligence, breach of contract, any tort, infringement of copyright or other intellectual rights caused by the exhibition or distribution or exploitation of any information or contents contained in these third parties cyber link sites.
  11. Privacy: Bank Alfalah Limited shall be retaining and using information relating to you in its computers and on the Internet Banking in any manner it deems fit whether such information has been obtained directly from you or from any third sources. Bank Alfalah Limited shall endeavor to maintain confidentiality regarding the information at the Internet Banking. However, such information may be disclosed in the following circumstances: a) If disclosure of information is required by Bank Alfalah Limited in any litigation or proceedings before a public authority relating to the Site. b) To persons acting as agents or advisors of Bank Alfalah Limited c) To any person to whom Bank Alfalah Limited transfer its rights and duties. d) If so required by law, by regulatory authorities, competent Court of Law, law enforcement agencies or as may be in accordance with the governing Law & market practices.
  12. No Warranties: Although due care is taken but Bank Alfalah Limited, it makes no representation or provides any warranty whether express or implied as regards the completeness of any information accessed from the Internet Banking.
  13. Severability: If any of these terms and conditions turns out to be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
  14. Entire Agreement: This is the entire Terms & Conditions /Agreement between the parties relating to matters contained herein and shall not be modified except in writing.
  15. Force Majeure & System Availability: (a) Bank Alfalah Limited shall l not be liable in any manner for failure to perform under these Terms & Conditions / Agreement for what so ever reasons including the reason that it is caused by power outages, internet outages, communication outages, fire, flood, earthquakes, hurricanes, war, civil commotion, acts of God, strikes, industrial disputes, or the occurrence of any other unforeseen contingencies beyond our control. (b) Bank Alfalah Limited shall take reasonably practicable steps to have the Bank Alfalah Limited Online View Service available for use. You accept that in case of routine maintenance or excess demand on the systems and circumstances beyond Bank Alfalah Limited control, it may not always be possible for the Bank Alfalah Limited Online View to be available during its normal operating hours.
  16. Disclaimer: The Internet Banking is being provided to you on an "as is" basis. No representation or warranties of any kind express or implied, including warranty of fitness for particular purpose, as to the operation of the Internet Banking or the nature of accuracy of the information included in the Internet Banking is being furnished. Bank Alfalah Limited and its affiliates will not be liable for any damages of any kind arising from the use of the Internet Banking or arising from any alleged negligence of the Bank including, but not limited to direct, indirect, incidental, punitive, and consequential damages.
  17. Data Integrity: You acknowledge that in case any dispute arose between you and Bank Alfalah Limited as regards the correct version of any records to which you would be having online access, the records as reflected in the database of Bank Alfalah Limited itself and certified by an officer of Bank Alfalah Limited to be correct, shall prevail.
  18. Release: You hereby release and forever discharge Bank Alfalah Limited and its officers, directors, employees, agents and affiliates, and their respective successors and assigns from any or all liability claims, counterclaims, demands, set off, damages, or any other causes of action, which may accrue, whether known or unknown, arising out of or in any way relating to use of the Internet Banking by you or involving your password specifically including but not limited to any claims based in whole or in part upon alleged negligence, in operating the Internet Banking or otherwise relating to it.
  19. Jurisdictional Issues:Access to and use of the Internet Banking is permissible under the laws of Bahrain. If you access this Internet Banking from any other location, you will do so at your own initiative and be responsible for compliance with the local laws, to the extent they are applicable.
  20. Bank Alfalah Limited shall not be required to independently verify any FT / IBFT or any other fund transfer transaction ("transaction"),if you perform any transaction (of what so ever nature) which may be erroneous due to any incorrect parameter / data entered by you, Bank Alfalah Limited shall not be responsible in any case for refund /return of transfer and disclaims any / all liability in this regard.
  21. Any transaction performed by you shall be effected only after Authentication being completed in accordance with the prescribed procedure for Internet Banking. Bank Alfalah Limited shall have no obligation to verify the authenticity of any transaction done by you other than your Login and Password and neither Bank Alfalah Limited nor its officers or Affiliates shall be liable for any unauthorized transactions occurring through Internet Banking. You hereby fully indemnify and hold Bank Alfalah Limited and its officers and Affiliates harmless against any action, suit, proceeding initiated against it or any loss, cost or damage incurred by it as a result thereof.
  22. Internet Banking and its Services provided by Bank Alfalah Limited shall vary as per Customer's Account, Product (s) and Services availed by the Customer.
  23. Bank Alfalah Limited shall charge financial charges such as annual charges and any other charges as per schedule of charges on each and every transaction or as the Bank Alfalah Limited may determine from time to time, such charges shall be debited from the Account of the Customer and Customer hereby agrees / acknowledges the debit authority of the Bank Alfalah Limited for such charges.
  24. All the applicable tax as per governing law shall debited by the Bank Alfalah Limited.
  25. Governing Laws: This Agreement is governed by the laws of Bahrain and the courts of Bahrain shall have exclusive jurisdiction in the matter.
  26. I/we, hereby, undertake that this account will not be operated by me/us on behalf of any third party. In case of any transaction to be conducted on behalf of a third party; I/we shall inform the bank accordingly. In case of any suspicion whatsoever; bank may use its right to seize the operations of account till complete satisfaction about the genuineness of the transaction.
  27. Termination: Bank reserves the right to terminate your access to the Internet Banking at any time without citing any reasons.

 

Data Privacy Notice

Bank Alfalah Limited (hereafter referred to as "we" or “our” or "us" or “BAFL” or “organization”) respects your right to data privacy. In this Notice “You” or “Your” refers to data subject (customers, employees, website visitors or contingent workers) whose personal data is processed by BAFL.

This privacy notice explains who we are, how we collect, share and use personal data about you, and how you can exercise your data privacy rights. The details on what personal data will be processed and which method will be used depend significantly on the services applied for or agreed upon.

Definitions

Data Subject - An identified or identifiable living individual natural person.

Personal Data - Any information relating to a data subject who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that data subject.

Processing - Any operation or set of operations which is performed on Personal Data or on sets of  Personal Data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

Special Category / Sensitive Personal data - Any Personal Data that reveal, directly or indirectly, an individual’s race, ethnical origin, political or philosophical opinions, religious beliefs, affiliation to union, personal criminal record, or any information in relation to his health or sexual condition.

 

Contingent workers - Contingent workers means non-permanent workers including agents, consultants, independent contractors, sub-contractors, temporary workers, professional advisors, interns and those affiliated with third parties.

Data Controller - A person who, either alone or jointly with other persons, determines the purposes and means of Processing any particular Personal Data; except that where the purposes and means of the Processing of Personal Data are determined by law, the person entrusted with the Processing obligation is deemed for the purposes of this Law to be the data controller.

Joint controller - Where two or more controllers jointly determine the purposes and means of processing, they shall be joint controllers.

Group company (Group) - includes a holding company, subsidiary, associate company (including a joint venture company) and a subsidiary of a holding company to which the company is also a subsidiary.

When do we collect your Personal Data?

Direct interactions

You may give us your identity, contact, resume by filling in forms or by corresponding with us by phone, and email or otherwise. This includes sharing of Personal Data for the following purpose:

  1. Records of your interactions with us such as emails and other correspondence and your instructions to us;
  2. Providing your feedback;
  3. By filling in forms, for example to download white papers and/or gather insights on case studies;

Automated technologies or interactions

Log Files. Log information is data about your use of the service, such as IP (Internet Protocol) address, browser type, referring/exit pages, operating system, date/time stamps, and related data, which is stored in log files.

Cookies may be used for many purposes, including to enable certain features of our service and remember your preferences, your equipment, browsing actions and patterns, to better understand how you interact with our service, to provide you advertising on and off the service, and to monitor usage by visitors and online traffic routing. What Personal Data do we collect?

Marketing and Communications data

We do not collect any Personal Data for marketing purposes. However, we may ask you to leave a review or take a survey for providing you better services. We may also collect your Personal Data for responding to your queries and comments, social media posts and questions/ queries. If you would like to opt-out/ unsubscribe from marketing or promotional communications from BAFL, you can do so by by clicking the unsubscribe button in the next email communication you receive from BAFL.

Aggregated Data (sometimes referred to a pseudonymised data)

We also collect, use and share aggregated data (sometimes referred to a pseudonymised data) such as statistical or demographic data for any purpose. Aggregated data may be derived from your Personal Data but is not considered Personal Data in the applicable law (s) as this data does not directly or indirectly reveal your identity. For example, we may aggregate your usage data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect aggregated data with your Personal Data so that it can directly or indirectly identify you, we treat the combined data as Personal Data which will be used in accordance with this data privacy notice.

Sensitive Personal Data or Special Category of Personal Data

We do not collect, store and use the following “special categories” of Sensitive Personal Data regarding you such as:

  1. Information about your race or ethnicity, religious beliefs and sexual orientation;
  2. Information about your health, including any medical condition, health and sickness records, medical records and health professional information;
  3. Any criminal records information in relation to you, and
  4. Biometric information about you, for example fingerprints, retina scans.

 

Our intent is not to collect or process any Special Category of Personal Data about you, unless required by applicable laws. However, in certain circumstances, we may need to collect, or request your Special Category of Personal Data for employment related purposes via resume shared, for example, data regarding your hobbies and preferences, gender and disabilities for the purposes of equal opportunities monitoring, to comply with anti-discrimination laws and for government reporting obligations.

 

How and why do we use your Personal Data?

We will only use your Personal Data when the law allows us to. We will use your Personal Data in the following circumstances:

  1. The Processing is necessary for reasons of substantial public interest, or for official purposes or requested for by the police or governmental authorities on a lawful basis;
  2. It is necessary for the establishment, exercise or defense of legal claims, for the purposes of carrying out the obligations and exercising our or your rights in the field of employment, social security and social protection law; or
  3. Based on your explicit consent;
  4. Where we need to perform the contract we have entered into with you;
  5. Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests;
  6. Where Processing is necessary in order to protect the vital interests of the Data Subject or of another natural person.

 Legitimate Interest

  1. Means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the best and most secure experience;
  2. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your Personal Data for our legitimate interests;
  3. We do not use your Personal Data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by laws).

Note that we may process your Personal Data for more than one lawful ground depending on the specific purpose for which we are using your data. However, we normally collect Personal Data from you only where we have your consent to do so, where we need the Personal Data to perform a contract with you, or where the Processing is in the legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms. Who do we share your Personal Data with?

On occasion we may have to share your Personal Data with the parties set out below for the purposes set out.

Internal Third Parties

Entities, subsidiaries and businesses within our Group. For example, we’ll share information from our website at https://www.BAFL.com.bh/ with the internal third parties, having similar arrangements between our other businesses. This is because we hope to have a relationship with you across all our businesses, if not now, then sometime in the future and we want to be able to provide you with the same value for money and high quality experience for the services provided to you by us. It’s also the only way we can provide you with the best benefits.

External Third Parties

  1. Regulators and other authorities: acting as processors or Joint Controllers based in Bahrain who require reporting of Processing activities in certain circumstances.
  2. With social media companies such as Facebook, Twitter and LinkedIn: who run promotions for you on their platforms;
  3. Any new business partners: we may have over time, for example, in the event of a joint venture, reorganization, business merger or sale that affects us.
  4. The Police, local authorities, the courts and any other government authority: if they ask us to do so (but only if our doing so is lawful).
  5. Other people who make a ‘data subject access request': where we are required to do so by law.
  6. We may also share the information we collect where we are legally obliged to do so, e.g. to comply with a court order.
  7. Any social media posts or comments you send to us: (on the BAFL Facebook page, for instance) will be shared under the terms of the relevant social media platform (e.g. Facebook, Twitter and LinkedIn) on which they’re written, and could be made public. Other people, not us, control these platforms. We’re not responsible for this kind of sharing. Before you make any remarks or observations about anything, you should review the terms and conditions and privacy policies of the social media platforms you use. That way, you’ll understand how they will use your information, what information relating to you they will place in the public domain, and how you can stop them from doing so if you’re unhappy about it. It’s worth remembering too that any blog, review or other posts or comments you make about us, our products and services on any of our blogs, reviews or user community services will be shared with all other members of that service and the public at large. You should take extra care to ensure that any comments you make on these services, and on social media in general are fit to be read by the public, and are not offensive, insulting or defamatory. Ultimately, you are responsible for ensuring that any comments you make comply with any relevant policy on acceptable use of those services.
  8. Third parties: to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your Personal Data in the same way as set out in this privacy notice. We require all third parties to respect the security of your Personal Data and to treat it in accordance with the law. We do not allow our third party service providers to use your Personal Data for their own purposes and only permit them to process your Personal Data for specified purposes and in accordance with our instructions.

International Transfers

We share your Personal Data within the Group on need to know basis with confidential obligations mentioned here in. This may involve transferring your data outside the Kingdom of Bahrain.

Some of our external third parties are based outside the Kingdom of Bahrain and so their Processing of your Personal Data will involve a transfer of data outside the Kingdom. Whenever we transfer your Personal Data out of the Kingdom, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

  • We will only transfer your Personal Data to countries that have been deemed to provide an adequate level of protection for Personal Data and are whitelisted by the Authority.

How we protect your Personal Data?

We use appropriate technical and organizational measures to protect the Personal Data that we collect and process. The measures we use are designed to provide a level of security appropriate to the risk of Processing your Personal Data.

A lot of the information we receive reaches us electronically, originating from your devices, and is then transmitted by your relevant telecoms network provider. Where it's within our control, we put measures in place to ensure this 'in flight' data is as secure as it possibly can be.

Sensitive data like, passwords are protected for data in transit by data encryption. In addition to encryption, we have implemented robust network security controls to help protect data in transit. Network security solutions like firewalls and / or network access control to secure the networks used to transmit data against malware attacks or intrusions.

We use secure means to communicate with you where appropriate, such as 'https' and other security and encryption protocols.

 

How long will we keep your Personal Data?

To make sure we meet our legal data protection and privacy obligations, we only hold on to your information for as long as we actually need it for the purposes we acquired it for in the first place. After that we will either delete it, mask it or anonymize it so that it cannot be linked back to you.

We retain Personal Data we process where we have legitimate interest, performance of the contract, vital interest of Data Subject or of another natural person, performance of a task carried out in the public interest or in the exercise of official authority vested or for the purposes of satisfying any legal, accounting, or other regulatory reporting requirements or with your consent.

By law we have to keep basic information about our customers (including contact and identity data) for 10 years after they cease being customers for legal purposes.  

 

Automated Decision Making

Automated decisions are decisions concerning you which are made automatically on the basis of a computer determination (using software algorithms), without human intervention. We do not use automated decision making.
